ClubCash Legal Package v2.0<\/h3>\n<\/div>\n
\n

1. Definitions<\/h4>\n

‘ClubCash’<\/strong> means the operator of the ClubCash platform. ‘User’ means any registered customer.
\n‘Merchant’<\/strong> means an approved business accepting ClubCash payments.
\n‘Club’<\/strong> means an approved organisation offering memberships.
\n‘EURC’<\/strong> means the supported regulated stablecoin where available.
\n‘Wallet’<\/strong> means the custodial digital wallet provided through the Services.<\/p>\n<\/div>\n

2. Acceptance of Terms<\/h4>\n

By accessing or using the Services you agree to these Terms. If you disagree you must stop using the Services.<\/p>\n<\/div>\n

\n

3. Eligibility<\/h4>\n

Users must satisfy age, legal capacity and jurisdiction requirements. ClubCash may refuse or terminate accounts where permitted by law.<\/p>\n<\/div>\n

\n

4. Account Registration<\/h4>\n

Users must provide accurate information, maintain updated details and protect credentials. Accounts are personal unless expressly authorised.<\/p>\n<\/div>\n

\n

5. Identity Verification (KYC\/AML)<\/h4>\n

ClubCash may verify identity, source of funds, sanctions status and beneficial ownership. Transactions may be delayed, rejected or reported where required by law.<\/p>\n<\/div>\n

\n

6. Custodial Wallet<\/h4>\n

ClubCash is not holding any custodial wallet. Users control control the wallet & management of private keys. Clubcash is acting as a platform to integrate the membership & Payment workflow.
\nClubCash safeguards supported digital assets using commercially reasonable security controls. Availability varies by jurisdiction.<\/p>\n<\/div>\n

\n

7. EURC Transactions<\/h4>\n

EURC transfers may only be made to supported merchants and users where enabled. Blockchain settlement times may vary. Completed transactions are generally irreversible except where required by law.<\/p>\n<\/div>\n

\n

8. Deposits & Withdrawals<\/h4>\n

Funding and withdrawal methods depend upon supported banking partners and regulatory requirements. Additional verification may be requested.<\/p>\n<\/div>\n

\n

9. Merchant Payments<\/h4>\n

Merchants are responsible for goods and services sold. ClubCash provides payment processing and is not responsible for product quality or contractual disputes between users and merchants.<\/p>\n<\/div>\n

\n

10. Club Memberships<\/h4>\n

Clubs determine membership pricing, eligibility and benefits. ClubCash provides the technical platform unless expressly stated otherwise.<\/p>\n<\/div>\n

\n

11. QR Code Payments<\/h4>\n

QR codes must only be used through authorised ClubCash applications. Users must verify merchant details before confirming payment.<\/p>\n<\/div>\n

\n

12. Fees<\/h4>\n

Fees, where applicable, are disclosed before completion of a transaction. ClubCash may amend fees with reasonable notice.<\/p>\n<\/div>\n

\n

13. Refunds<\/h4>\n

Refund eligibility depends upon merchant policy and applicable consumer protection law. Approved refunds are returned to the original funding destination where practicable.<\/p>\n<\/div>\n

\n

14. Chargebacks & Disputes<\/h4>\n

Users should first contact the merchant. ClubCash may assist investigations but does not guarantee reversal of completed digital asset transactions.<\/p>\n<\/div>\n

\n

15. Acceptable Use<\/h4>\n

Users must not engage in fraud, money laundering, terrorist financing, sanctions evasion, unlawful gambling, malware distribution, abusive behaviour, infringement of intellectual property or any unlawful activity.<\/p>\n<\/div>\n

\n

16. Fraud & Security<\/h4>\n

ClubCash may temporarily suspend transactions where suspicious activity is detected. Users must immediately report unauthorised access.<\/p>\n<\/div>\n

\n

17. Privacy & GDPR<\/h4>\n

Personal information is processed in accordance with the ClubCash Privacy Policy and applicable data protection legislation including GDPR where applicable.<\/p>\n<\/div>\n

\n

18. Intellectual Property<\/h4>\n

All software, trademarks, graphics, logos and content remain the property of ClubCash or its licensors.<\/p>\n<\/div>\n

\n

19. Suspension & Termination<\/h4>\n

ClubCash may suspend or terminate accounts for breach of these Terms, legal obligations, fraud prevention or security concerns.<\/p>\n<\/div>\n

\n

20. Regulatory Compliance<\/h4>\n

Services are available only where legally permitted. Features may differ between jurisdictions.<\/p>\n<\/div>\n

\n

21. Apple App Store Terms<\/h4>\n

This agreement is between the User and ClubCash, not Apple. Apple has no responsibility for maintenance, support or claims relating to the application except as required by applicable law. Apple and its subsidiaries are third-party beneficiaries of these Terms. Any in-app purchases will comply with Apple’s App Review Guidelines.<\/p>\n<\/div>\n

\n

22. Google Play Terms<\/h4>\n

Distribution through Google Play is subject to applicable Google Play policies. Google is not responsible for operation of the Services.<\/p>\n<\/div>\n

\n

23. Limitation of Liability<\/h4>\n

To the maximum extent permitted by law, ClubCash excludes liability for indirect, incidental and consequential damages. Nothing excludes liability that cannot legally be excluded.<\/p>\n<\/div>\n

\n

24. Indemnity<\/h4>\n

Users agree to indemnify ClubCash against losses arising from breach of these Terms or unlawful use of the Services.<\/p>\n<\/div>\n

\n

25. Force Majeure<\/h4>\n

ClubCash is not liable for delays caused by events beyond reasonable control including natural disasters, cyberattacks, telecommunications failures, war or governmental action.<\/p>\n<\/div>\n

\n

26. Governing Law<\/h4>\n

These Terms are governed by the law of the operating ClubCash entity identified on the website, subject to mandatory consumer rights.<\/p>\n<\/div>\n

\n

27. Contact Details<\/h4>\n

Legal notices, complaints and regulatory enquiries should be submitted using the contact information published on the official ClubCash website.<\/p>\n<\/div>\n

\n

Appendix A \u2013 Privacy Policy Summary<\/h4>\n

ClubCash collects account, transaction and device information to provide services,
\nmeet legal obligations, prevent fraud and improve security. Users may exercise applicable privacy rights
\nincluding access, correction and deletion where available.<\/p>\n<\/div>\n

\n

Appendix B \u2013 Merchant Responsibilities<\/h4>\n

Merchants must comply with consumer protection, tax, AML, sanctions and licensing
\nrequirements. Merchants remain responsible for the quality of goods and services supplied.<\/p>\n<\/div>\n

\n

Appendix C \u2013 Risk Disclosure<\/h4>\n

Digital assets may be subject to operational, regulatory and technological risks.
\nAlthough EURC is designed as a fiat-referenced stablecoin, redemption, availability and regulatory treatment
\nmay change.
